These Terms and Conditions apply to all offers, orders and agreements between JK Drum Systems B.V. and its customers through the online store available at www.jkdrumsystems.com .
By placing an order through the online store, you confirm that you have read and accepted these Terms and Conditions.

2. Definitions
In these Terms and Conditions:
- “Agreement” means the agreement between JK Drum Systems B.V. and the Customer concerning the purchase and delivery of one or more Products.
- “Business Customer” means a natural person or legal entity acting for purposes relating to its trade, business, craft or profession.
- “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.
- “Customer” means a Consumer or Business Customer.
- “Distance Agreement” means an agreement concluded between JK Drum Systems B.V. and a Consumer through an organised distance-sales system without the simultaneous physical presence of the parties.
- “Durable Medium” means any instrument that enables information addressed personally to the Customer to be stored for future reference and reproduced without alteration.
- “Product” means any physical product offered by JK Drum Systems B.V., including drum accessories, drum-system components and related products.
- “Right of Withdrawal” means the statutory right of a Consumer to withdraw from a Distance Agreement within the applicable withdrawal period.
- “Withdrawal Period” means the period during which a Consumer may exercise the Right of Withdrawal.
- “Terms and Conditions” means these terms and conditions.
3. Applicability
- These Terms and Conditions apply to every offer, order and Agreement concluded between JK Drum Systems B.V. and the Customer.
- These Terms and Conditions are available on the website and will be made available to the Customer before the Agreement is concluded.
- By placing an order, the Customer accepts the applicability of these Terms and Conditions.
- Any deviations from or additions to these Terms and Conditions are valid only if agreed in writing.
- If the Customer is a Business Customer, any purchasing terms or other terms of that Business Customer do not apply unless JK Drum Systems B.V. has expressly accepted them in writing.
- If any provision of these Terms and Conditions is invalid or unenforceable, the remaining provisions will remain in full force. The invalid or unenforceable provision will be replaced by a valid provision that reflects its purpose as closely as legally possible.
4. Offers and product information
- Offers are without obligation unless the offer expressly states otherwise.
- Each offer contains a description of the relevant Products and, where applicable, information concerning:
- the price;
- VAT;
- delivery charges;
- payment methods;
- delivery times;
- warranty information; and
- the Right of Withdrawal for Consumers.
- Product descriptions, specifications, images and illustrations are intended to provide an accurate representation of the Products.
- Minor differences in colour, appearance, dimensions or finish that do not affect the essential characteristics or functionality of a Product do not give rise to a right to compensation or cancellation, except where mandatory law provides otherwise.
- Obvious errors or mistakes in an offer, including pricing errors, do not bind JK Drum Systems B.V.
- If an offer is subject to a limited period of validity or specific conditions, this will be clearly stated in the offer.
5. Formation of the Agreement
- The Customer places an order by completing the ordering process on the website and submitting the order.
- Before submitting the order, the Customer will have the opportunity to check and correct the order.
- The Customer is responsible for providing accurate and complete information.
- After receiving an electronic order, JK Drum Systems B.V. will send an electronic confirmation of receipt.
- The confirmation of receipt confirms that the order has been received. The Agreement is concluded when JK Drum Systems B.V. confirms the order or begins executing it, unless mandatory law provides otherwise.
- JK Drum Systems B.V. may refuse an order or attach additional conditions where this is reasonably necessary, including in cases involving:
- suspected fraud;
- payment risk;
- incorrect pricing;
- repeated non-payment;
- unreasonable delivery requirements; or
- suspected misuse of promotional offers.
- If an order is refused after payment has already been made, JK Drum Systems B.V. will refund the amount paid without undue delay.
- JK Drum Systems B.V. will provide Consumers with the information required by law on paper or on a Durable Medium.
6. Right of Withdrawal for Consumers
- A Consumer may withdraw from a Distance Agreement concerning a Product within 14 days without giving a reason.
- The Withdrawal Period starts on the day after the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.
- If several Products are ordered in one order and delivered separately, the Withdrawal Period starts on the day after the last Product is received.
- If delivery of a Product consists of several consignments or parts, the Withdrawal Period starts on the day after the last consignment or part is received.
- In the case of a contract for regular delivery of Products during a specified period, the Withdrawal Period starts on the day after the Consumer receives the first Product.
- The Consumer may exercise the Right of Withdrawal by sending an unambiguous statement to info@jkdrumsystems.com.
- The Consumer may also use the model withdrawal form included in Annex I.
- The Consumer is not required to provide a reason for exercising the Right of Withdrawal.
- The Right of Withdrawal does not apply where a statutory exception applies and the Consumer was informed of that exception before placing the order.
- The Consumer’s statutory rights are not affected by any commercial return policy offered by JK Drum Systems B.V.
7. Obligations of the Consumer during the Withdrawal Period
- During the Withdrawal Period, the Consumer must handle the Product and its packaging with reasonable care.
- The Consumer may inspect and test the Product only to the extent necessary to establish its nature, characteristics and functioning, as would reasonably be permitted in a physical shop.
- The Consumer is liable for any decrease in the value of the Product resulting from handling beyond what is necessary to inspect and test the Product.
- The Consumer must return the Product with all supplied accessories and, where reasonably possible, in its original packaging.
- The Consumer should not apply labels, tape or other materials directly to the original Product packaging where this can reasonably be avoided.
- A Product does not automatically lose the Right of Withdrawal merely because its packaging has been opened or the Product has been inspected.
8. Return procedure and return costs
- The Consumer must return the Product without undue delay and no later than 14 days after notifying JK Drum Systems B.V. of the withdrawal.
- The Consumer has complied with the return period if the Product is sent back before the 14-day period has expired.
- The Consumer bears the direct cost of returning the Product unless:
- JK Drum Systems B.V. has agreed in writing to bear these costs; or
- JK Drum Systems B.V. failed to inform the Consumer before the purchase that the Consumer would bear the return costs.
- The Consumer is responsible for the return shipment until it has been received by JK Drum Systems B.V.
- JK Drum Systems B.V. recommends using a tracked shipping service and retaining proof of postage.
- Returns should be sent to:

The Netherlands - The Consumer should include the order number or a copy of the invoice with the return.
- Returns sent cash on delivery or with unpaid postage may be refused.
9. Refunds after withdrawal
- JK Drum Systems B.V. will refund all payments received from the Consumer, including the cost of the cheapest standard delivery method offered by JK Drum Systems B.V.
- Any additional cost resulting from the Consumer choosing a more expensive delivery method will not be refunded.
- JK Drum Systems B.V. will process the refund without undue delay and within the period required by applicable law.
- JK Drum Systems B.V. may delay the refund until:
- the returned Product has been received; or
- the Consumer provides evidence that the Product has been sent back,
- Refunds will be made using the same payment method used for the original transaction, unless the Consumer expressly agrees to another method.
- The refund is free of charge for the Consumer.
- Where the Product has lost value due to handling beyond what was necessary to inspect it, JK Drum Systems B.V. may deduct the corresponding decrease in value where permitted by law.
10. Prices
- All prices are stated in euros.
- Prices include VAT where applicable, unless expressly stated otherwise.
- Delivery charges and other additional costs will be displayed before the Customer completes the order, where required by law.
- The price applicable to the Agreement is the price displayed at the time the order is placed.
- Obvious pricing errors do not bind JK Drum Systems B.V.
- JK Drum Systems B.V. may change its prices for future orders.
- Price changes after the conclusion of an Agreement are permitted only where allowed by applicable law.
- A Consumer may terminate the Agreement where mandatory law grants such a right due to a price increase.
11. Payment
- Payment must be made using one of the payment methods offered during the ordering process.
- JK Drum Systems B.V. may suspend execution of the Agreement until payment has been received, unless mandatory law provides otherwise.
- The Customer must provide accurate and complete payment, billing and contact information.
- If payment is not made on time, JK Drum Systems B.V. may take the measures permitted by law, including:
- suspending delivery;
- cancelling the order where permitted;
- charging statutory interest where applicable; and
- recovering reasonable collection costs where legally permitted.
- Business Customers are not entitled to set off or suspend payments unless expressly agreed in writing or permitted by mandatory law.
12. Delivery and execution
- Products will be delivered to the address provided by the Customer.
- Orders are normally processed and shipped within five business days after payment has been received, unless another period is stated at checkout or agreed in writing.
- Delivery periods are estimates unless expressly agreed as a firm deadline.
- Delivery times may be affected by:
- stock availability;
- supplier delays;
- carrier delays;
- customs procedures;
- extreme weather;
- government measures; or
- circumstances beyond the reasonable control of JK Drum Systems B.V.
- JK Drum Systems B.V. will inform the Customer as soon as reasonably possible of any material delay.
- If delivery is impossible or materially delayed, the Customer retains any statutory right to cancel or dissolve the Agreement.
- If a Product is unavailable, JK Drum Systems B.V. may offer:
- a replacement Product;
- a revised delivery date; or
- a refund,
- For Consumers, the statutory maximum delivery period and statutory remedies for late delivery remain applicable.
- Unless otherwise agreed in writing, the risk of loss or damage to a Product passes to a Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.
- For Business Customers, risk passes upon delivery to the carrier or upon handover of the Product, unless otherwise agreed in writing.
13. International delivery, customs and taxes
- JK Drum Systems B.V. may deliver Products to countries outside the Netherlands.
- International delivery times depend on the destination, carrier, customs procedures and local conditions.
- Unless expressly stated otherwise at checkout, the Customer may be responsible for:
- import duties;
- customs charges;
- local taxes;
- clearance costs;
- brokerage charges; and
- other charges imposed by the destination country.
- The Customer is responsible for providing accurate and complete delivery, customs and tax information.
- JK Drum Systems B.V. is not responsible for delays caused by customs, local authorities or local carriers, except where mandatory law provides otherwise.
- The Customer is responsible for ensuring that the Product may lawfully be imported and used in the destination country, unless mandatory law places that responsibility on JK Drum Systems B.V.
- Consumers may retain mandatory rights under the law of their country of residence where those rights apply.
14. Product safety and use
- The Customer must use, install, maintain and store the Product in accordance with all applicable instructions, warnings and safety information provided by JK Drum Systems B.V.
- Before using a Product, the Customer must check whether it is:
- complete;
- undamaged;
- correctly assembled;
- suitable for the intended application; and
- securely positioned.
- The Customer is responsible for ensuring that the floor, surface, drum rug, mat, platform, fastening system and any other materials used with the Product are suitable, stable, sufficiently strong and safe.
- The Product must not be used on an unsuitable, unstable, wet or excessively slippery surface where this may create a risk of:
- movement;
- tipping;
- falling;
- instability; or
- damage to persons, animals, property, instruments or other equipment.
- The Customer must inspect the Product regularly and must stop using it immediately if it is damaged, defective, loose, excessively worn or otherwise unsafe.
- The Customer must not modify, repair or alter the Product unless this has been expressly authorised in writing by JK Drum Systems B.V.
- The Customer must ensure that the Product is used only for its intended purpose.
- To the maximum extent permitted by law, JK Drum Systems B.V. is not liable for damage caused by:
- use contrary to instructions or safety warnings;
- improper installation or assembly;
- use on an unsuitable or unsafe surface;
- improper maintenance or storage;
- modifications or repairs by the Customer or third parties;
- continued use after a defect or damage has been discovered; or
- use in combination with unsuitable third-party Products or materials.
15. Conformity and commercial warranty
- JK Drum Systems B.V. warrants that the Products comply with the Agreement and with the mandatory statutory requirements applicable at the time the Agreement is concluded.
- Consumers retain all statutory rights relating to conformity. Nothing in these Terms and Conditions limits or excludes those rights.
- Unless a different period is expressly stated for a particular Product, JK Drum Systems B.V. provides a commercial warranty of one year from the date of delivery.
- The commercial warranty applies only to defects attributable to defective materials or workmanship.
- The commercial warranty does not cover:
- normal wear and tear;
- damage caused by improper or unintended use;
- improper installation, assembly, maintenance or storage;
- failure to follow instructions or safety warnings;
- modifications or repairs by the Customer or an unauthorised third party;
- excessive loads or use outside the intended purpose;
- water damage or damage caused by extreme weather conditions;
- damage caused by unsuitable floors, surfaces, mats, drum rugs or third-party Products;
- damage caused by transport arranged by the Customer after delivery; or
- damage that is aggravated because the Product continued to be used after a defect was discovered.
- Any commercial warranty is additional to and does not replace or restrict the statutory rights of Consumers.
- For Business Customers, the commercial warranty applies only if expressly agreed in writing or stated for the relevant Product.
- The Customer must give JK Drum Systems B.V. a reasonable opportunity to inspect and, where appropriate, repair or replace a Product claimed to be defective.
16. Complaints
- The Customer should inspect the Product as soon as reasonably possible after delivery.
- Complaints should be submitted to info@jkdrumsystems.com as soon as reasonably possible after the issue has been discovered or should reasonably have been discovered.
- A complaint should include:
- the order number;
- a description of the issue; and
- photographs or other relevant information where reasonably available.
- The Customer should report visible transport damage as soon as reasonably possible, preferably within 48 hours of delivery.
- A request to report visible transport damage promptly does not limit any statutory rights of a Consumer or any claim that cannot lawfully be excluded.
- JK Drum Systems B.V. will respond to a complaint within 14 days.
- If a complaint requires more time, JK Drum Systems B.V. will confirm receipt and provide an indication of when a substantive response may be expected.
- The Customer must give JK Drum Systems B.V. a reasonable opportunity to investigate and, where appropriate, repair, replace or otherwise resolve the issue.
17. Liability
- Nothing in these Terms and Conditions excludes or limits liability to the extent that such exclusion or limitation is prohibited by mandatory law.
- To the maximum extent permitted by law, JK Drum Systems B.V. is not liable for indirect or consequential loss, including:
- loss of profit;
- loss of revenue;
- loss of production;
- loss of business;
- loss of anticipated savings;
- loss of goodwill;
- reputational damage;
- missed opportunities;
- travel expenses;
- event-related losses;
- loss caused by delay;
- loss resulting from the inability to use the Product;
- damage to instruments or equipment not supplied by JK Drum Systems B.V.; or
- damage to property used in combination with the Product.
- To the maximum extent permitted by law, JK Drum Systems B.V. is not liable for damage caused by:
- improper or unintended use;
- use contrary to instructions or safety warnings;
- improper installation, maintenance or storage;
- use on an unsuitable, unstable, wet or excessively slippery surface;
- modifications or repairs by the Customer or third parties;
- use after a defect or damage has been discovered;
- inaccurate or incomplete information supplied by the Customer;
- third-party Products, materials or services;
- acts or omissions of carriers, suppliers or other third parties, except where JK Drum Systems B.V. is legally responsible; or
- circumstances attributable to the Customer.
- For Business Customers, liability for direct damage arising from or relating to an Agreement is limited to the amount invoiced for the Product or Products directly giving rise to the damage, unless mandatory law provides otherwise.
- If and to the extent liability is covered by an insurance policy maintained by JK Drum Systems B.V., liability will be limited to the amount actually paid by the insurer in respect of the relevant claim, subject to the applicable policy terms, exclusions, limits and excess.
- The existence of insurance does not constitute an admission of liability.
- The Customer does not acquire a direct right to payment by the insurer merely because JK Drum Systems B.V. has insurance, unless mandatory law provides otherwise.
- The limitations in this article do not apply to liability that cannot lawfully be excluded or limited, including certain forms of liability for:
- death or personal injury;
- defective Products;
- intent;
- deliberate recklessness by the management of JK Drum Systems B.V.; or
- any other liability that cannot be limited under mandatory law.
- If any limitation of liability is invalid or unenforceable, the remaining limitations will remain in force to the maximum extent permitted by law.
18. Force majeure
- JK Drum Systems B.V. is not liable for delay or non-performance caused by circumstances beyond its reasonable control.
- Force majeure includes, among other things:
- strikes;
- war;
- terrorism;
- pandemics or epidemics;
- government measures;
- transport disruptions;
- supplier delays;
- material shortages;
- fire;
- flooding;
- cyber incidents;
- failures of hosting, payment or communication providers;
- customs problems;
- extreme weather; and
- power or network failures.
- During a force majeure situation, JK Drum Systems B.V. may suspend its obligations or terminate the Agreement in whole or in part if performance has become impossible or cannot reasonably be expected.
- If the force majeure situation continues for a prolonged period, either party may terminate the Agreement to the extent permitted by applicable law.
- Amounts already paid for Products that have not been delivered will be refunded where required by law.
19. Intellectual property
- All intellectual property rights relating to the website, product descriptions, images, photographs, logos, texts, designs and other content made available by JK Drum Systems B.V. belong to JK Drum Systems B.V. or its licensors.
- The Customer may not reproduce, distribute, publish, modify or commercially exploit such content without prior written permission.
20. Privacy
- JK Drum Systems B.V. processes personal data in accordance with its Privacy Policy.
- The Privacy Policy is available at: Privacy page
- The Privacy Policy forms part of the information provided to Customers but does not form part of these Terms and Conditions unless expressly stated otherwise.
21. Applicable law and jurisdiction
- Agreements with Consumers are governed by Dutch law, without prejudice to mandatory consumer protection provisions that apply in the Consumer’s country of residence.
- Any dispute with a Consumer will be submitted to the court having jurisdiction under the applicable mandatory procedural rules.
- Nothing in these Terms and Conditions limits the Consumer’s right to bring proceedings before a court that has jurisdiction under applicable law.
- Agreements with Business Customers are governed by Dutch law.
- Any dispute arising from or relating to an Agreement with a Business Customer will be submitted exclusively to the competent court of the District Court of Oost-Brabant, location ’s-Hertogenbosch, the Netherlands, unless mandatory law provides otherwise.
- The United Nations Convention on Contracts for the International Sale of Goods is excluded.
22. Amendments
- JK Drum Systems B.V. may amend these Terms and Conditions from time to time.
- Amendments will not affect Agreements already concluded, unless mandatory law provides otherwise.
- The version applicable to an Agreement is the version available at the time the order was placed.
